Please read these terms carefully before using the TalentZilla platform and services.
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the TalentZilla platform, website, and related services (collectively, the "Service"). TalentZilla is owned and operated by Xcellence IT, located at 220, Multi Storied Building Complex, Near 21st Century Building, Singapuri Ni Wadi, Ring Road, Surat – 395002, Gujarat, India. By visiting our website, creating an account, or using any feature, you agree to these Terms.
2. Description of Service
TalentZilla is a SaaS hiring and applicant tracking platform. Features include resume intake, AI-based analysis, skill scoring, job management, interview scheduling, and hiring dashboards. Features may be updated, modified, or removed without notice. We do not guarantee feature availability in every plan.
3. License to Use the Service
Xcellence IT grants you a limited, non-exclusive, non-transferable, and revocable license to use TalentZilla for internal recruitment and hiring. Sublicensing, reselling, or commercial exploitation without permission is prohibited.
4. User Accounts
You are responsible for:
- Providing accurate registration information.
- Maintaining the confidentiality of your login credentials.
- All activities occurring under your account.
Notify us immediately at privacy@talentzilla.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
5. Payment and Billing
Fees are billed in advance (monthly, quarterly, or annually). Payments are non-refundable unless required by law. Failure to pay may result in service suspension. We reserve the right to modify pricing with reasonable notice.
6. Use of AI Features
TalentZilla uses AI for parsing, evaluation, and ranking. AI outputs support workflows but do not replace human decision-making. We do not guarantee accuracy, completeness, or lack of bias in AI outputs.
7. AI-Assisted Decision Disclaimer
AI-generated scores are automated and may contain limitations. TalentZilla does not make hiring decisions; all employment actions are the sole responsibility of the hiring organization. Users must independently review AI outputs for compliance.
8. Candidate Data
Candidate information becomes visible to the hiring organization upon application. Hiring organizations must use this data responsibly and comply with privacy and employment laws.
9. Customer Data Responsibility
Hiring organizations are solely responsible for the accuracy, legality, and ownership of data they process, including job postings and candidate info. Ensure you have appropriate rights to process this data.
10. Acceptable Use
- No spam or misleading job postings.
- No illegal, harmful, or offensive content.
- No reverse engineering or copying the Service.
- No harvesting data for non-hiring purposes.
11. Restrictions on Competitive Use
You may not use TalentZilla to build, benchmark, or improve a competing product. Copying features, workflows, UI, or AI capabilities is strictly prohibited. Automated scraping is banned.
12. Intellectual Property
All software, AI systems, designs, and branding belong to Xcellence IT. User-generated content (resumes, posts) remains the property of the submitting user or organization.
13. Third-Party Services
Integrations with LinkedIn, WhatsApp, or job boards follow their own terms. Xcellence IT is not responsible for third-party data handling.
14. Beta Features
Experimental features are provided "as is" and may be unstable, incomplete, or subject to change without notice.
15. Data Retention
We may retain data for operational or legal reasons after account termination. Afterward, data may be permanently deleted without notice.
16. Security Disclaimer
While we use reasonable security measures, we do not guarantee protection against hacking, data loss, or unauthorized access.
17. Availability
We do not guarantee uninterrupted operation. Maintenance or technical issues may cause temporary downtime.
18. Limitation of Liability
Xcellence IT is not liable for indirect, incidental, or consequential damages. Total liability is capped at the amount paid during the current billing term, maxing at the last 12 months' fees.
19. Hiring Responsibility
We are not responsible for hiring decisions, employment outcomes, candidate qualifications, or interactions between employers and candidates.
20. Governing Law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Surat, Gujarat.
